American Trucking Association has its Day in Court

Several years ago the Port of Los Angeles implemented a number of provisions as part of its Clean Trucks Program which limited the trucking companies permitted to serve the port. The program, designed to limit pollution, allows only those companies that have received special licenses to haul goods to and from the nation’s busiest port. 

In 2008, the American Trucking Association filed a lawsuit against this program. Their position is that Congress has been clear since the deregulation of the industry in 1980, decisions such as this should be made by the marketplace not by government regulators. 

The Supreme Court took the case in January and will likely offer its opinion in July.
