Transportation Stakeholders Challenge Out-of-State Registration Fees
On Tuesday, October 8th, the Owner-Operator Independent Driver Association (OOIDA) filed suit in New York on behalf of their out-of-state members who have been forced to pay a $15 registration and $4 decal fees to operate on New York highways.
According to OOIDA, “The requirement results in out-of-state truckers paying a higher per-mile tax, in violation of the federal Commerce Clause because it imposes an undue burden on interstate commerce”. OOIDA is seeking a permanent injunction against the taxes, a refund for previously collected fees, and the subsequent attorney costs associated with this lawsuit.
In January of this year, the state of New York began requiring a decal be affixed to affected trucks and trailers operating on state highways, excluding the tolled portions of the New York State Thruway. The state can impose fines, interest, penalties and seize property of truck owners who do not pay in a timely fashion.
